How to Complete a Visa Application
Unless you have an in-depth knowledge of the UK immigration system, applying for a Visa of any kind is a confusing and stressful process.
UK immigration law is constantly changing and keeping track of all the complex policies and processes can be a nightmare.
Luckily, this is our job, and with experienced immigration solicitors from Aamer Anwar on your side, who will offer dedicated advice and has an extensive knowledge of all UK immigration application matters, you will have an extra level of reassurance and confidence when submitting your visa application.
To give you a general of the Visa acquisition process, these are the 5 main stages that we will go through with you when applying:
1) An analysis of your personal circumstances
In order to provide the best possible immigration advice for your needs, we will first need to look at your specific situation and begin to develop a plan.
After an initial advice session we will prepare a detailed analysis based on your personal circumstances as a private client, with continuous consultation throughout, and then provide our professional advice on the best route forward.
2) Submit your application
During the application process itself we will ensure that all the required documentation and paperwork is as it should be and is submitted in a timely manner.
We will advise you in advance of exactly what documents will need to be submitted as part of your application so you are not forced into a panic searching for papers that are not actually required.
Before the final submission, our immigration experts will carefully go through your entire application, using their extensive knowledge of UK immigration rules to spot any potential errors that could cause delays or rejection.
3) Legal Representation
Once completed, our immigration lawyers will strengthen your case further by providing legal representations.
Having experienced immigration lawyers take their time to do this will ensure that your application has the very best possible chance of being accepted.
4) Final Submission
Once all the documentation required by the home office has been completed and strengthened by our team oprofessional immigration lawyers, it is time for one final check.
Once this has been completed it is finally time for your Visa application to be submitted, either by you or by our qualified immigration experts.
5) The Decision
Once the application for your desired visa has been submitted your immigration journey is hopefully nearing its end.
Whilst under consideration, our immigration specialists will carefully monitor the progress of your application with the relevant authorities in an attempt to speed up the process in your favour.
We understand that this can be an incredibly stressful and nerve-racking wait and to help give you some peace-of-mind our immigration support team will be on hand 24/7 if you need a chat.
If your Visa application is rejected by the home office it may be possible for you to appeal the decision.
If this is the route you would like to go down then being represented by our team of immigration lawyers will give you the very best chance of success in an immigration and asylum tribunal.
The Immigration Act 2014 has significantly impacted the right of appeal for those who have seen their applications rejected in the UK, so if you are unsure about whether or not it is worth, or even possible, to appeal the decision it is advised that you always seek the advice of a reliable immigration lawyer.
The appeal options that you have will be very much dependant on the type of application that you have submitted, but in general, you will usually have one of the following options:
Administrative Review of Visas
Within 14 days of a decision being made on your application, you will be able to request that the outcome be reconsidered via an administrative review.
This will cost a fee and you must explain in detail the exact reasons why you feel that the wrong decision was made.
You will normally be unable to submit any new information as part of this review which if granted will simply involve your original submission being reconsidered.
Paying the fee and applying for an administrative review doesn’t guarantee anything and in most situations, the decision will remain unchanged so only go down this route if your dedicated immigration solicitor advises that there is a real chance of successfully reversing the outcome.
Immigration and Asylum Tribunal Appeal
If your application is rejected you may have the right to appeal to the First Tier Immigration and Asylum Tribunal.
In order to do so, you will need to submit a notice of appeal with full grounds justifying the submission and a specified fee.
You will then be allocated a tribunal hearing date when your appeal will be heard and will have to attend court on that date.
Having expert personal immigration lawyers Glasgow representing you is essential in immigration asylum appeal court cases.
You will be expected to provide all the evidence you intend to use in court, including witness statements and supporting documents to the court beforehand.
You will then have to present your case in court via oral evidence and will be cross examined by a representative of the home office.
An immigration lawyer will not only make sure all the supporting evidence is submitted on time, but they will also represent you in court, and prepare you for cross-examination, giving you the best possible chance of overturning the decision.
If your application to have your case for appeal heard at the first tier tribunal hearing it may be possible to appeal the decision at the upper tribunal but only if there is evidence that there has been an error of law.
Attempting to take this route unsuccessfully could have damaging consequences however, and you may lose your right to appeal altogether so you should seek professional advice from an immigration solicitor before doing anything rash.
If your application is rejected without any right to appeal the only possible way that you can challenge the decision is through judicial review.
Judicial review is a process in which a judge will consider the lawfulness of a decision or action made by a public body.
If your Visa application has been refused with no right to appeal, our team of immigration lawyers may be able to help by way of judicial review and we have a fantastic record challenging the home office in this manner.
