    How to Complete a Visa Application

    Unless you have an in-depth knowledge of the UK immigration system, applying for a Visa of any kind is a confusing and stressful process.

    Appeal

    If your Visa application is rejected by the home office it may be possible for you to appeal the decision.

    The Immigration Act 2014 has significantly impacted the right of appeal for those who have seen their applications rejected in the UK, so if you are unsure about whether or not it is worth, or even possible, to appeal the decision it is advised that you always seek the advice of a reliable immigration lawyer.

    The appeal options that you have will be very much dependant on the type of application that you have submitted, but in general, you will usually have one of the following options: 

     

    Administrative Review of Visas

    Within 14 days of a decision being made on your application, you will be able to request that the outcome be reconsidered via an administrative review. 

    This will cost a fee and you must explain in detail the exact reasons why you feel that the wrong decision was made.

    You will normally be unable to submit any new information as part of this review which if granted will simply involve your original submission being reconsidered.

    Paying the fee and applying for an administrative review doesn’t guarantee anything and in most situations, the decision will remain unchanged so only go down this route if your dedicated immigration solicitor advises that there is a real chance of successfully reversing the outcome.

     

    Immigration and Asylum Tribunal Appeal

    If your application is rejected you may have the right to appeal to the First Tier Immigration and Asylum Tribunal. 

    In order to do so, you will need to submit a notice of appeal with full grounds justifying the submission and a specified fee.

    You will then be allocated a tribunal hearing date when your appeal will be heard and will have to attend court on that date.
