    Human Rights Lawyer

Basic human rights are something that many of us take for granted, but what should you do if you believe that you have suffered an infringement of these rights?

Being the victim of a human rights breach can be hugely upsetting and emotionally draining and getting the correct legal advice and representation is essential to success in human rights cases.

Aamer Anwar are Scotland’s highest profile law firm with a team of qualified solicitors who have extensive experience of representing clients in human rights cases.

    What are your human rights?

The Human Rights Act 1998 put into public law the rights and freedoms that every single person in the UK is entitled to.

If you believe that you have suffered an infringement of any of the rights defined in the Human Rights Act 1998, you should seek the advice of a specialist human rights lawyer as soon as possible.

Before making a claim it is important to know exactly what your human rights are.

The rights in the Human Rights Act passed by the UK Government in 1998 were taken directly from the European convention on human rights (ECHR) and set out a number of articles that deal with a different right each.

Some of the key civil liberties that underpin everyday life in the UK include:

For more details, and to examine each and every article, the act can be viewed in full at: https://www.legislation.gov.uk/ukpga/1998/42/contents

If you are unsure as to whether what you have suffered could be considered a breach of your human rights, contact a human rights lawyer who will examine the details of your case and advise you on the best way forward.

What does the Human Rights Act mean?

By incorporating the rights set out in the ECHR into British law, the Human Rights Act 1998 means that if you believe that your human rights have been breached you are now able to seek justice at a British court, when previously you would have had to go through European Court of Human Rights.

It also means that it is the responsibility of public bodies such as state schools, police forces, public hospitals, local councils, and other local authorities to do all they can to both respect and protect your fundamental human rights.

If you believe that any of these institutions have failed to do so and you have been the victim of human rights abuses you should get in touch with an experienced international human rights lawyer immediately.

Why do you need a Human Rights solicitor?

Human rights law involves a lot of complex legislation and having an expert solicitor to support you and guide you through the entire process can significantly reduce the stress of human rights cases.

It is vital that you get in touch with a human rights lawyer as soon as you think you may have been the victim of a human rights violation as in many instances the law requires court proceedings to be instigated within a certain timescale.

For example, civil claims seeking compensation for human rights breaches must be issued in court within 12-months of the incident taking place and human rights solicitors will require as much time as possible to gather evidence and prepare the best possible case on your behalf.

The nature of the case in question will very much decide what legal action you are able to take, for example, if you are involved in a employment dispute you would need to take your case to an employment tribunal, and having a lawyer on hand will make sure you know the most appropriate route to go down at all times.

They will also be able to advise you as to what the most likely outcomes are for the case, helping you to set realistic expectations.

The most common remedies agreed through court action in human rights cases are:

    • Financial compensation or damages
    • An order requiring a public authority to take certain action in order to fix the situation – known as an injunction.

Just because a court finds evidence that your human rights have been breached does not mean that you will automatically receive compensation and it is the responsibility of a human rights solicitor to demonstrate the loss that you have suffered as a result of the incident.

What do Human rights solicitors do?

A human rights lawyer is a lawyer who provides victims of human rights violations with legal counsel.

Their main responsibility is to challenge discrimination and defend the basic human rights of those they represent.

Some of the main tasks performed by most human rights lawyers include:

    • Advising clients to ensure they are aware of what their individual human rights are.
    • Explaining each stage of the process of making a claim.
    • Gathering evidence and talking to witnesses and clients to build a strong case.
    • Representing their clients in business and human rights court cases.
    • Researching previous cases involving both individual and institutional claimants.
    • Negotiating with the lawyers who are representing the other parties.
    • Ensuring that any agreement is implemented in full.
    • Handling judicial review claims.
    • Advising people on other related aspects of law such as environmental law, policy law, immigration human rights laws, or international criminal law.
    • Managing data protection concerns.
    • Advising on administrative and public law legislation to protect civil liberties
    • Advising corporate and public body groups on their obligations under the modern slavery act
    • Keeping clients informed at all stages of our work. Human rights cases can be very complex at times.
