Knowing your Human Rights
Before you or your legal representation decide if you have a basis to make a human rights claim, it is important to understand exactly what your human rights are.
In 2000, the Human Rights Act 1998 was passed by the UK Government.
This act put into UK Public law the rights that every UK resident is entitled to, taking these directly from the already established convention rights defined in the European Convention on Human Rights (ECHR).
The Human Rights Act 1998 is separated into a number of different articles, each of which deal with a different right and gives certain parameters indicating what would be considered a breach.
This act defines the following as fundamental rights and freedoms those in the UK are entitled to:
- Article 2 – Right to life
- Article 3 – Freedom from torture and inhuman or degrading treatment
- Article 4 – Freedom from slavery and forced labour
- Article 5 – Right to liberty and security
- Article 6 – Right to a fair trial
- Article 7 – No punishment without law
- Article 8 – Respect for your private and family life, home and correspondence
- Article 9 – Freedom of thought, belief and religion
- Article 10 – Freedom of expression
- Article 11 – Freedom of assembly and association
- Article 12 – Right to marry and start a family
- Article 14 – Protection from discrimination in respect of these rights and freedoms
- Protocol 1, Article 1 – Right to peaceful enjoyment of your property
- Protocol 1, Article 2 – Right to education
- Protocol 1, Article 3 – Right to participate in free elections
- Protocol 13, Article 1 – Abolition of the death penalty
If you that you have had one or more of these human rights violated, it is essential that you contact a law firm with a fully qualified and experienced human rights team as soon as possible.
Civil claims must be issued within 12-months of the incident and the sooner you begin legal action the higher the chances of securing compensation.
What is the impact of the Human Rights Act?
By making into UK public law the rights set out in the ECHR, the Human rights act has a couple of major impacts on UK citizens.
Firstly, If you are the victim of a human rights violation you are now able to have your case heard in a UK court, where as in the past you would have had to go through the European Court of Human Rights.
Secondly, it means that all public bodies in the UK now have the responsibility to do all they can the protect the human rights of those under their jurisdiction.
Some of the institutions that a required by law to protect the human rights of citizens include the police, schools, hospitals, councils, and various government departments.
If you feel that any public body compromised or breached any of the rights set out in the Human Rights Act you may be eligible for compensation and should consider using a Human Rights firm to take legal action.
Why get Legal Representation?
The Human Rights Act sets out your rights and freedoms in clear simple terms, but the legal process involved in making a claim can be incredible complex.
Having an experienced solicitor by your side can be invaluable when dealing with human rights breaches, guiding you through the entire process and significantly increasing the chances of securing an acceptable outcome.
Some of the most valuable reasons to hire a human rights law firm when involved in cases involving civil liberties include:
Reduced Stress
Being the victim of a human rights violation can be hugely traumatic and the stress associated with recounting and thinking about the incident on a daily basis can be overwhelming.
Many people even decide never to pursue cases involving human rights due to the upsetting nature of the situation.
With a human rights lawyer doing all the leg work for your case, you will be able to seek the justice you deserve without all the pressure of dealing with the problem on your own.
Expert Guidance
The best route to go down when seeking justice for a human rights breach is dependent on a number of factors including the nature of the case in question and the time that has passed since the incident occurred.
There are a broad range of different incidents that could be classed as human rights offences.
These range from medical negligence and false imprisonment to serious injury claims caused as a result of lax safety by local authorities or private companies.
Each different type of human rights case requires a different legal approach, and only an expert human rights lawyer with an in depth knowledge of administrative and public law will be able to advise you on the best way forward.
Set realistic expectations
Using their many years of experience, once a human rights lawyer has examined all the details of your case, they will be able to give you a good idea of the best possible outcome from the legal action you intend to take.
